Overview of Statues and Guiding Principles

Objectives:

In this unit, we will begin to explore the major statutes and rules and guidance’s that govern every aspect of the major activities we conduct in a disability services office in higher education.  This unit will provide an overview of the ADA, ADAAA, Section 504, DOJ regulations, OCR settlement agreements, and other guidance from OCR. 

 

Gain a basic understanding of the major sources of disability law that govern higher education.

Learn where to look to find the legal information disability services professionals need.

Better understand the ways sources of law and the agencies that enforce them interact.

The overwhelming margin by which Congress passed the ADAAA raises interesting questions about the legislative process. 

1)    If the Court’s decisions, limiting the scope of coverage of the ADA, were clearly inconsistent with Congress’s original intent, why did it take nearly a decade for Congress to reverse those Court decisions through legislation?

2)    Why did it take nearly a decade for Congress to reverse those decisions through legislation?

3)    What were the precipitating factors that caused these amendments to be enacted in the fall of 2008? 

4)    Would such a sweeping amendment to the ADA happen today?
